HISTORY OF CONSTITUTION Issues a) The 20th century in the history of law: the crisis of the end of the century ; b) Unity vs. plurality: the debate between these two positions as typical of the constitutional doctrines of the 20th century; c) monographic profiles: Orlando, Romano, Kelsen, Schmitt
HISTORY OF CODIFICATION Issues: Codification in France (Code Napoleon), Italy (1865 Codes and Zanardelli Code), Germany (BGB), Fascism and codification, Codification in contemporary age

Learning Objectives
Knowledges: knowledge of the main characteristics of modern law and, more specifically, of the juridical culture of the 19th and 20th century. Focus on the most important arguments of the period between these two centuries and on the main doctrinal assumptions.
Skills: capability to put in the right historical dimension the laws and regulations of contemporary age by virtue of their recent past; capability to perceive the principal aspects of a certain juridical culture, following an interdisciplinary approach which stretches over the different dimensions of law and catches possible interactions with similar disciplines.
Competencies: ability to catch and recognize the deep marks that history – as a fundamental dimension of law – leaves on regulations and above all on the culture where it belongs and that must be used to interpret these very same regulations. Sensibility for the comparative aspects of the events that have determined the juridical culture of the 19st and 20th century, as fundamental to understand their transnational (and European in particular) dimension.
Prerequisites
Students who wants to pass the exam as ATTENDING students will have to enroll in a specific list by the date that will be made known at the beginning of the course

The oral examination will aim to verify: a) Knowledge of the concepts and ideas discussed during the course; b) Ability to process these concepts in an autonomous way; c) Awareness of historicity as necessary aspect of law and knowledge of historical and conceptual roots of legal institutions
Course program
HISTORY OF CONSTITUTIONS
a) The doctrines of the modern state: analysis and study of the features of the modern notion of “ state “ within the progressive process of its historical definition. b) The doctrines of constitutions: the fundamental characteristics of modern constitutions, starting from the revolutions of the late 18th century. c) Between the 19th and the 20th century: the doctrines of the liberal State as dominant frame of government of the 19th century, from its genesis to decline; d) The 20th century in the history of law: the crisis of the end of the century in the different branches of law and pluralism as its main attribute. e) Unity vs. plurality: the debate between these two positions as typical of the constitutional doctrines of the 20th century. f) characteristics of the 20th century constitutional State.
HISTORY OF CODIFICATIONS
Genesis and development of codification practice and ideology from the origins of the Enlightenment to the 20th century. Some of the following topics will be particularly investigated:
- French Revolution and Napoleon Code
- The Italian legislative unification and the codes of 1865
- The penal code Zanardelli (1889)
- The codification in Germany up to the BGB
- Fascism and codification
- Codfication in contemporary age and current trends
