Course Content
Introduction to the structure of Islamic law, its place in modern legal systems, and its interaction with the legal tradition of the main Western countries.
Students actively attending the course will prepare the exam on their notes.
Students not attending the course will use the following texts:
1) F. Castro, Il modello islamico, 2a ed. ( G.M. Piccinelli ed.), Giappichelli, Torino, 2007, pp. 3-155, e
2) D. Scolart, L' Islam, il reato, la pena. Dal fiqh alla codificazione del diritto penale, Istituto per l’Oriente, Roma, 2013, chapters 1, 2, 3, 7, 8; one chapter chosen between 4 and 5; one chapter chosen between 9, 10 and 12.
An alternative program me with texts in English can be agreed with the professor.
Learning Objectives
Knowledge: Historical evolution and sources of Islamic law, visions of Islamic law dominant within non-Islamic societies, interactions between Islamic law and state law.
Skills: Understanding the practical consequences of the position of a specific rule in the system of Islamic law; critically assessing in terms of balance between interests the tensions between Islamic law and state legal systems Competences
Familiarity with the categories of Islamic law
Prerequisites
Students must have passed the exams of general constitutional law, Private law I, Comparative legal systems.
