The course aims to rethink the contractual remedies through a comparison between different sources of law: civil code, sector regulation, national and european case law.
Particular attention will be spend on the right of an effective remedy provided by art. 24.2 and 3 of the Italian Constitution, art. 6 and 13 of the ECHR, art. 47 of the Charter of Fundamental Rights of the UE and art. 19 TUE.
