The course is divided into two parts and will focus on major legal issues concerning environmental protection needs. The first part of the course will give a general introduction to the legal framework concerning environmental protection. During the second part, the seminars will focus on Legislative Decree no. 152/2006 (“Provisions on environmental matters”)

Learning Objectives
KNOWLEDGE
The purpose of the course is to provide participants with knowledge of the legal framework on environmental protection and of recent developments on the subject from an international, European and national point of view (the reform of Title V of the Italian Constitution will be addressed as well). Seminar sessions will focus on how constitutional and administrative jurisprudence have interpreted Legislative Decree no. 152/2006 (“Provisions on environmental matters”) and in particular on waste management and disposal, on reclaiming polluted sites, on air protection, and on compensation for environmental damage.
SKILLS
Participants will acquire the ability to procure legal documentation (legislation, case law and legal literature) in order to solve key legal problems concerning environmental protection and in particular waste management and disposal. Participants will also acquire the capacity to solve legal problems thanks to an immediate identification of relevant legislation on a multidisciplinary level.
COMPETENCE
Participants will gain proficiency in dealing with the constitutional and interdisciplinary legal framework currently governing environmental protection. They will also acquire the capability to identify legal issues related to the current social and economic context which is going through a particularly complex and dynamic phase of renewal.
Prerequisites
In order to qualify for this course and be eligible to sit for the final exam, students must have achieved a passing mark on the exams for the following courses: Diritto costituzionale generale, Diritto privato I, Diritto amministrativo.
Independent study due mid-course: All participants will be expected to prepare a paper on a case study.
Final exam: oral examination
Course program
The course is divided into two parts and will focus on major legal issues concerning environmental protection needs. Learning methodology is based on a multidisciplinary approach and is open to the contributions of professors from the Law Faculty as well as to the concrete experiences of European Union, national and regional officials.
The first part of the course will give a general introduction to the legal framework concerning environmental protection. An analysis of the main aspects of environmental issues will be carried out and will be directed to showing how these issues have been addressed up to now from a legal point of view and at an international, European, and national level.
During this first part of the course, Constitutional Court case law concerning the implementation of Title V (in particular, environment and ecosystem protection) will be analysed as well.
During the second part, the seminars will focus on Legislative Decree no. 152/2006 (“Provisions on environmental matters”) and in particular on the fourth section on waste and reclamation, the fifth section on air protection and on the sixth section on compensation for environmental damage.
